Judge: Apex woman not competent for murder trial

A judge has ruled that an Apex woman isn't competent enough to stand trial in the beating death of her husband last year.

RALEIGH, N.C. — A judge has ruled that an Apex woman isn't competent enough to stand trial in the beating death of her husband last year.

Jolene Kay Hardy, 56, of 3804 Perney Court, is charged with murder in the July 2009 death of Gerald Douglas Hardy, 60, who was found dead in the couple's home. An autopsy report states that he was beaten to death.

Jolene Hardy told investigators that she fought with her husband and struck him in the head, face and body with a hammer, according to a search warrant. After Gerald Hardy lost consciousness, his wife cleaned up the blood from his body and the scene, the search warrant states.

She initially told a 911 dispatcher that Gerald Hardy suffered from lymphoma and tried to get himself killed so he wouldn't die of the illness, but she changed her story when investigators questioned her.

A relative of Gerald Hardy said both Hardys complained of relationship problems as far back as 2004.
