Guardsman's deployment delays sentencing in fatal wreck
The sentencing of an Elm City man in a fatal wreck last Christmas Eve has been delayed until after he returns from a deployment to Iraq.
Posted — UpdatedRobert Kubas, 19, pleaded guilty to a lesser charge of misdemeanor death by vehicle. He originally faced involuntary manslaughter charges in the death of Peggy Winstead Cade, 43.
Investigators said that Kubas was speeding when his vehicle collided with Cade's at Lake Wilson Road and London Church Road.
A judge agreed to delay Kubas' sentencing until his Army National Guard Unit returns from Iraq. Kubas will deploy with his unit Dec. 1.
A conviction of misdemeanor death by vehicle carries a jail sentence between one and 45 days, while involuntary manslaughter, a felony, carries a sentence of three to 59 months.
