DURHAM, N.C. — A grand jury on Tuesday refused to indict a Durham man who had been charged with stealing stealing a trailer containing low-grade explosives.

Derrick Dion Downey was arrested in June on a charge of possession of weapons of mass destruction after Durham police found a trailer that they said might have previously carried low-grade explosives.

The trailer was empty when police found it at the Town and Country Convenience Store near the intersection of Fayetteville Road and Cook Street. It had contained copper wiring and material used for electrical welding when it was stolen from a hotel parking lot on Miami Boulevard, police said.
