about elcid89
With all of the complaining that goes on here (some of you honestly seem incapable of doing anything else BUT complaining ...), GoLo has become depressing.
With the general trend towards the banal and inane, GoLo has become a waste of my time.
What is it about this place, which has so much promise of bringing people together to discuss ideas and learn from one another, that it brings out the worst in people instead?
You'll forgive me if I take my leave of it.

Did Governor Easley do something illegal, or even unethical, about inquiring into the possibility of his wife getting a state-paid job, and then entering into discussions about it? I can't think of any couple I know of who wouldn't handle it the way this pair have done if the wife wanted a job with the same employer as her husband.
All other possible no-nos aside - the campaign contributions, trips, and Mary Easley's pay raise - was Governor Easley's participation in her hiring illegal?

Possibly from the same place that some got the idea that Americans would be better served by choosing "average joes" to be our leaders. I don't want someone "just like me" to be my leader. I want someone better. And I certainly don't want someone like Joe the plumber or Sarah Palin, whose only apparent qualification is a lack of knowledge of, or interest in, the world outside their own limited experience.
For those who do want that, intellect and academic achievement make you one of the dreaded "them" and not one of "us". I suppose America has always had its share of thes folks. I can only hope their ranks aren't growing - just their visibility.

Point taken - I wasn't sure if North Carolina had a law forbidding it. Do NOT think I'd like to be Governor. Nope, no thanks.

Well, after 8 years of being non compliant with my Doctor, 4 weeks ago I finally opened my eyes and have gotten a handle on this blasted type 2 diabetes. I am walking up to 4 miles a day, being very an al about my carb intake, and have gone from 240 to 216 in a month. That truck should get smaller every day, and I'm sure if you listen to your doctor, everything will be fine. Hang in there, and I look forward to seeing you back on GOLO on a regular basis soon. We might be opposite on a lot of things, but that will never preclude me wishing you a sincere GET WELL SOON. And now....I must go for my morning walk. Jerry

I've always heard that a merchant is never required to sell anything at any price, even if it was the correct price.

I have a legal question for you, prompted by a comment on my blog today. If a doctor wished to run a very simple private practice, and be able to charge lower fees, would it be possible for him to only serve patients who agreed to waive their right to sue him for malpractice?
Presumably, the quid pro quo for this waiver would be the lower fees, and perhaps easier access to a doctor who didn't have a huge case load.
It would be a niche market, to be sure, but I doubt it would be possible financially without avoiding the cost of malpractice.

Perhaps if the needed treatment was urgent and dire, or there were no other options available. But what about the person who elects, at a time when he is not sick, to become a regular patient of this particular practice, knowing that right around the corner are more expensive practices that don't have such a requirement? Is this not simply an informed choice, made freely by a reasonable consumer?
Is it not akin to a "ride at your own risk" feature in other commercial enterprises?

It's highly dependent on what was advertised and how it was advertised. The next time you read a sale circular, try to find the part with the really small writing. It will contain all sorts of disclaimers intended to protect the seller from legal action stemming from failure to perform."
But I don't think a merchant is required by law to sell anything at all to anyone. They can kick you out of their store if they think your breath stinks. Surely they also can refuse to sell you something.
I'm really curious about this. Is there a law that requires a merchant to sell anything at all, even if it's on their store shelf with a price tag on it? I don't think so. I think they can kick everyone out and lock their door if they like, without giving anyone a reason.

NCGS ยง 14-117 (http://law.justia.com/northcarolina/codes/chapter_14/gs_14-117.html)"
Actually, I was aware of false advertising. So I can't intentionally run an add to sell a nice truck for $45 if I have no intentions of selling it.
My point was that even if I did that, I'm not require by law to actually sell it. (Although, according to that statute, I'd be guilty of false advertising if I did that...)
