In theory, I get what you're saying but in reality, there are too many variables.
1 in this country, it's cheaper to maintain an inmate serving life than it is carry out the death penalty.
#2 the justice system is flawed (mainly because of the human element) so even if the verdict is guilty, sometimes there's not a for sure that the person is actually guilty and vice versa (think OJ).
And #3 Specifically in NC, you can be convicted of 1st degree murder even if you did not do the actual killing. Ex. if you and a friend rob bojangles and you don't have a weapon but your friend uses a utensil from the restaurant to kill someone, you could be convicted of 1st degree murder even though you didn't touch the person that died.

The typical murderer, HAIL NO! I feel nothing bad for them but in the case of people with mental defect, yes. There are people on golo with autistic children and i'm sure they will tell you that depending on the severity of the autism, they can be totally unaware of what they're doing, even up to injuring someone.

why? i dont understand the logic, is it because you feel bad for them or something? to me a killer (1st degree) is a killer whether theyre retarded or not. self defense killings are another subject though

I agree with that for the most part, however, someone that's been deemed mentally retarded cannot appreciate the consequences of their actions or sometimes even control them.
I don't think this is one of hose cases but there are examples where autistic people murder someone, I don't think it would be right to execute an autistic person.
