speed trapping and radar

A favorite of law enforcement officers all over the state, and a not so favorite for the ones who get caught:

"I didn't realize I was driving that fast sir."

"What? No way, your radar is wrong"

"Deputy, I really had to pee...did you expect me to wet my pants?"

"I'm on my way to the hospital, its an emergency"

"Trooper, may I see the radar please"

"What about the guy in front of me that was doing at least 80, but you stopped me instead"

"Ummm revoke my license on the spot? You can't do that" (yes we can)

We hear it all.  Some politely accept the fact that speed kills and they were indeed exceeding the limit. Works for me - here's your WARNING ticket, now slow down please.  Others - are content to argue and argue and argue and in some cases - argue themselves out of the ticket and into a nice pair of trinkets. Not something I was expecting to accomplish but hey, whose counting.

Are speed traps legal in the state? yup....can we run radar from a residential driveway in a neighborhood that we recieve a wide level of speeding complaints? Sure can....Do we actually even NEED radar to stop a person for speeding and issue either a verbal warning or a state citation? Nope. Wanna know a really sneaky trick we bad cops play? Here's a freebie - I'll back my car between the vehicles on display at car dealerships and run radar....you never even see me.  I'm dastardly like that.

Although I myself prefer radar, I don't necessarily need it, per supreme court rulings. yes, I know - radar is not infallible, its only as accurate as the user, the cop will lie and use the radar as an "excuse" blah blah blah.  Heres the facts folks:

No, we cannot "tamper" with the radar in order to raise the speed that you were going just so we can write specifically "you" a ticket.

Yes, the radar does have its "moments" as far as accuracy - if in doubt, I don't stop the car.  25% of all radar tickets are in error. The most noticeable and common mistakes include shadowing, RFI interference, cosine error and mechanical interference. We as officers all understand this.

Under NC training standards, officers are not simply handed a Crown Vic equipped with Eagle 2's and told to go forth and multiply. We attend a pretty comprehensive 40hr course with strict training standards that employs use of radar and estimation within 4 mph without radar.

Now, I'm going to really burst your bubble.  You know those really expensive Cobra's and K band radar detectors (among others) that you spend all that money on so you can speed on our freeways?  they dont work!! But *sigh* it does give you that sense of "security" huh....

Passive jammers and active jammers are designed on the theory that when an officer shoots your car with either a radar signal or laser the signal the radar/laser is reflected back to the officers device, with an added FM chirp.

The problem with this theory, if you are further away then three feet from the  radar signal, the reflected signal from your expensive detector is not strong enough to jam. There's more but I won't reveal it all here.

In short - with what I have in my unit - when your chirp goes off, I've already got you. Aint it great!!! My system uses your jam as a reflect and sends the signal back you - after I have acheived a "lock".  Theoritically, I use your own detection signal against you.

My advice? Just slow down...whats the hurry? The movie is not going anywhere, the sale will advertise again, its better to get poked in the eye for being late for work instead of never arriving again.

Enforcement of NC statute 20-16.1 is mainly what I try to focus on. That is the mandatory suspension of driver's license upon conviction of excessive speeding, exceeding by more than 15 miles per hour the speed limit, either within or outside the corporate limits of a municipality, if you were also driving at a speed in excess of 55 miles per hour at the time of the offense, or driving at a speed in excess of 80 miles per hour at the time of the offense. These are the so-called "real money" tickets.  Speeds that no doubt can get you or others around you killed quick.

Do I care if the speed limit is 55 and you are doing 60? no, get real....I'm more interested in the speed demons and lead foots that are legitimately hauling azz.

When you get up in the mornings and running a little late, gotta stop by daycare before the late fee kicks in - if you see the lone patrol cruiser sitting at the crest of the hill in the center of the grass - slow down because you never know....

Had a bad experience with a cop running radar and there is just NO WAY (in your mind) you were doing what he/she said you were - post it......

"Enforcement of NC statute 20-16.1 is mainly what I try to focus on. " This part confused me, Is it upon conviction to just being stopped for doing over 55 OR over 80??

I drive an old Ford Escort station wagon. No matter how fast you drive, they never look like they're going over 35 mph, even to a radar.

Normally, its the one that are flat out honest with me at the very start that drive away with the warnings. Start giving me lip - the court date is circled at the top...

My satellite radio goes out momentarily when I pass some officers. Does that have anything to do with radar?

Some random guy - upon conviction.

I've never received a warning from an LEO, always the speeding ticket. I'm polite, don't offer excuses, and do exactly what they ask me to do. Oh well...guess that's how it is for some us.

What's the limit for an on-the-spot confiscation? I know there has to be one!

Mizzz - could be signal interferrance....kinda like when some detectors chirp when passing businesses due to the alarm systems inside

I'm just curious b/c I always hear that driving too slow is just as much of a hazard as driving too fast - do the very slow drivers (like those doing about 40-45 on the beltline in good weather) ever get warnings or citations?

Also, when a "caravan" of speeders is cruising along how do you decide which to pull? I've always wondered. Is it the first one in the group or the last - or someone in the middle? If I am asking you to give up any secrets then I apologize. It's not often that you get the chance to pick the brain of a LEO about speeding laws.

440 is THE worst! Those people have to be going 75-80 mph...it's insane.

Daz - There are statutes that address driving to slow so as to impede traffic but you would hardly see that enforced - too dangerous. Our radar units can be programmed to pick out the fastest vehicles within a group of vehicles, its operators choice on how to set it up.

DaStone- they give the ticket to the person who pulls over! Of course if you don't pull over you could get a much worse criminal charge of ignoring the blue lights!

The speeding suspension is ON the CONVICTION for speeding. They can take your license immediately for DUI charge.

My husband used to teach radar/vascar down in Salemburg so I am very familiar with the information in your blog. I always got a big laugh at the stories he used to come home with.

I developed my own system, and since implementing it, have not gotten a speeding ticket. I obey the posted limit. I KNOW! Who ever thought that would work?

Tru - you ever give out any RCC? I want one!

Randy and True - I am so glad you guys could work it out! This has been a day of peace and respect - starting with Hilikus' blog today!

That's pretty interesting. I guess those radars must be some pretty sophisticated equipment. Pretty expensive too, I would bet.

Thanks for keeping the "crazies" out there on the road in line.

RCC? the hell is dat?

I wish you guys would take a day off from running radar to pull over the jack---es who do 55 and refuse to get out of the left lane. I don't have any sympathy for people doing 85 in a 65, but honestly, I think the left lane campers contribute more to unsafe conditions than even the hardcore speeders. Of course, I don't think it's even against the law to do this so long as you're not exceeding the speed limit, at least in NC...this state desperately needs a "keep right, except to pass" statute on the books.

Raleigh City Code - not sure what group of true blue you are in.

but i like Raleigh City Codes! much better offense. I tell people to pay those immediately! no questions asked.

What about this...

What if I'm driving down a long country road, doing the speed limit, and out of no where some bat out of he11 comes flying up behind me, whips around me, and is into the sunset, out of sight in 3.2 seconds. Then, a minute later, a State Trooper rolls up behind you with the blue lights on, Pulls you, and gives you a ticket. (this happens you know)

Raleigh City Code does not get reported to DMV and does not go on your record. I can look up the RCC for speeding if you want!

Unfortunately the city is trying to make them not quite as popular!

sgebeaux,

Kinda got to agree with you! I got one because I was pulled over letting a one of my friends out after school! I was at almost at the drive way when this “orange GTO” came around me hauling azz.I pulled over to let this guy out .Chuck said “ahh man that cop’s pulling in behind you”! Bam 60 in 55!! I don’t think I even made 50. I only went maybe two miles down the road!

How about the adding of 10 miles per hour to the ticket so you can only plead it down? I was pulled for doing 63 - when I saw the sherrif, I looked at my speedometer and it said 53. What a coincidence that the ticket was for exactly 10 above what I saw. The road that I got the ticket on (Ray road heading up the hill from 540 at the turn) is a favorite trap and I no longer go there in the morning. I drive that road a lot, and if I truly did 63 going uphill around that turn in my jeep, the tires would be squealing.

Tru - What are the pitches of the 35 and 55 mph tuning forks used to calibrate the radar before and after each and every shift and each and every stop during which radar is used?

The worst ticket i have seen is a 6 over - 51 in a 45 - and in the space in the middle were the officer writes the true speed radar-ed - it was 51. The Da dismissed it immediately. I see a few 9 over every once in a while - with the true speed int he middle of the ticket as 9 over. Usually get dismissed too.

Con - politely accept the ticket - don't argue, the trooper is an enforcement tool, people tend to not realize that and take it out on the focal point instead of the one who actually makes the decision. Explain the facts to the judge. The ball is now in the troopers court to prove the case.

Pleshy - I calibrate at the start of each shift and I recalibrate mine after each and every stop I used radar for.

NEVER EVER take it out on the police - they then write stuff on the ticket they turn in to the DA - like DO NOT REDUCE and other things. You only mess yourself up. And can lead to more charges!

Nope - Ray rd, Harnett's finest *smirk* huh....10 over is normally a little of a higher fine.

Every time I have been pulled except once I have received a ticket. I was speeding every time except that one where I was not given one. The one time I did not get the ticket I did have a gun pulled on me out of mistaken identity...as long as the trigger isn't pulled I'd rather have that happen than get the ticket =P

SGE - I do exactly that. When they act like a total azz, I'm polite, courteous, professional. Then I go back to my patrol car and hook em up real nice on the white copy that goes to the DA.....

If you stay polite and show respect, it'll be returned...I have had an unfortunate amount of incidents where I was able to prove it to myself.

Tru - the 10 over was over the speed that I was doing. If the ticket said what I was really doing - 6 or 8 over the limit, it is possible that I could have had it dismissed, rather than reduced. That is why he added 10 to it. Harnett's finest?

I've got up to the vehicle and they were in tears...never been stopped and scared to death.....Or had mom or dad roll up and once everything was explained by me to dad, I released them to the parent - no ticket. Its alot more entertaining to watch dad whup junior's fourth point of contact on the side of the road.

Nope - you said Ray rd, were you in Harnett County?

No, Ray is off of Strickland and ends at Norwood. It passes over 540 between leesville and creedmoor rd exits. This is a favorite trap because you come down a big hill to 540 and to stay under the limit, you would have to stand on the brakes the whole time.

I have a heavy foot and always drive too fast! If I get a speeding ticket, it's legit and you won't hear me complain. I have to really have my mind on my driving or set my cruise.

Ahhh The fayetteville district. I know alot of those guys, nice unmarked white SUV's they have *smile*

Shoebaby - I would never write you anyway *grin*

True Blue - I know, every cop using radar is required to calibrate in that manner as a SOP for running radar. My question is What are the pitched for the two tuning forks used to calibrate. The speeds being calibrated are 35 and 55 - but the tuning forks have a pitch, a musical note. What are the musical notes for the calibrating tuning forks?

My mom, uncle(s), cousin, ex-husband, and brother are/were all LEO's. Until I started working in the ER, I got a ticket every time I was pulled, was always told "you should know better"..except once in Fayetteville, the officer asked me what was my hurry, I was on my way to a bachelorette party after being 'nominated' to buy the party favors. I told him "I'd tell you, but it'd prolly make you blush" He said "If you can make me blush, I'll let you go" I pointed to the HUGE bag in the backseat that said "Pricilla's" on it and said "I just left there and I'm going home to get my GROOVE on"...he turned away, threw his hands up said "You got me, SLOW DOWN, and have a nice day"

"Con - politely accept the ticket - don't argue, the trooper is an enforcement tool,". - tool, indeed.

"Then I go back to my patrol car and hook em up real nice on the white copy that goes to the DA....." - enforcement only, eh? no trying to infuence the DA/ judge from you, right, quotaboy? another vindictive fool who believes the HIS WORD IS THE LAW.

I've NEVER received a speeding ticket. The most I ever go is 9 over, and I've never been pulled for speeding.

Pleshy - ok - here goes: Its not a "note" per say, rather the frequency of that of a megahertz. Radar is a doppler system operating on microwave frequencies. The forks are labeled with a calibration speed and a radar band. The forks are usually labled "35" and "45" respectively. When both forks are struck and vibrating simultaneously in front of the radar antenna, the patrol speed should read the lower speed fork, and the target speed should read the speed stamped on the higher fork, minus the speed on the lower fork. This is because the radar subtracts the patrol speed of 35 from the closing speed of 80 to calculate the target speed of 45. Confused?

Hey Monkey boy - sucks to be you...I'll write that on there too sometimes

Thank you True...

Christina - I had almost that exact scenario once, only she offered to demonstrate if I let her off with a warning...
