Hello GOLO:

Have you ever had an issue with a homeowner's association? I belonged to one for 8 years in Florida and never had a major issue, though I wasn't always happy with the policies.

I consider myself lucky though because I've heard some wild stories, and there were many of them in the Sunshine State.

Just want to point out the story on WRAL-TV about  a homeowner whose association tried to force her to replace the trim on her house AFTER they approved it..at a cost of nearly $18,000.

How about you? Do you have an HOA horror story? Do tell.

37 feet. That's a big boat! However, I'd like to think if my neighbor rolls up in his yard w/one to work on, I'd at least go talk to him before I started complaining. Funny how things can work out if you just communicate.

Our HOA is fairly strict but we haven't had any run ins with them to speak of. Occasionally I see things like, a zillion campaign signs in people's yards and I am surprised its allowed considering the other things they do not allow that seem just as petty.

I moved out of Apex to get away from an HOA. I'll never buy a house with an HOA agreement. Signing this agreement is tantamount to surrendering your basic American freedoms. Don't do it.

Try putting up a ham radio antenna, even an unobtrusive one. The 'Yard Nazis' will fight it tooth and nail. They are expressly forbidden by federal law from restricting amateur radio antennas, but they do it anyway. I pay $50 a month for this?

I have only lived in one HOA for about 8 months. We had bought a condo and were using it as transitional housing while we built a new house in the country. I couldn't rent anything for less than what I paid for it. I bought it for $32,000 and with a coat of paint sold it for $68,000 8 months later.

I would never live in another HOA though. They have there useful purposes for some people out there, but not for me. We enjoy living in the country with no neighbors, and having all the critters I want with no complaints or permission from anyone other than the wife.

Wait until your neighborhood is overrun by those who literally don't know the different between grass and weed, or what basic property upkeep means. You may think twice about the value of an HOA.

Our HOA is very reasonable. People submit plans for remodeling or painting and they sail through fairly easily. I know, I'm on the Review Committee.

I intend to do a small remodel myself and anticipate zero problems.

I made it perfectly clear to our HOA that they can kiss my pearlescent pale white rear end if the jerk neighbour to our south can't be bothered to come round and communicate with us before sending letters to the HOA and his insurance company about leaning trees.

This guy tried telling us that his previous HOA demanded that neighbour disputes be handled by the HOA rather than solved between the neighbours. I thought that patently absurd...no HOA willingly signs up to be party to the multitude of petty problems that crop up in any neighbourhood. That'd be way too much like work...

Fortunately, most of the neighbours round us are actually quite decent sorts. It's just this one set that is clinically insane...

Harrison- You have those folks too? It's funny because my HOA sends out beautification notices 3-4 times/yr and nothing changes. They're wasting my dues on those worthless notices.

I consider my HOA to be fairly innocuous. That said, it has gotten some bad press lately for requiring a couple to remove fake grass from their yard. Heck, it's not like it's astroturf or anything. After hearing about the hub-bub, I decided to sneak a peek for myself...I'm jealous, it looks and feels like the real thing (better than the real thing if you've suffered through 2 yrs of drought restrictions).

My only issue is that most of the "business" that the HOA conducts stems from complaints. Example, a neighbor built a rock-lined pond of some kind on the side of his house and had it there for some time before he was unceremoniously told to dismantle it. True...his fault for not running his plans through the board, but it didn't get ANY attention for a while...I'm sure some Kravitz complained.

Personally, I thought it was somewhat tacky too, but to each his/her own. THAT principle is what HOA's get in the way of.

HATE HATE HATE H.O.A.'s!!!! My hard earned money, my house, my yard, MY RULES!!!

Lived in Florida for many years. Zoned residential/agricultural, northern condo commandos started arriving and start an HOA. Many that have lived there for years never invited. Flagpoles,trucks RV's, boats, cars with signs, all banned. Still feuding, I guess. Now live rural.

Our HOA is continuously sending us letters about our mailbox posts needing to be "cleaned", mailboxes needing to be just like everyone else's and our trashcans needing to be moved. I wish that is all I had to worry about. I have rotting wood on my house that needs to be replaced. My mailbox post is the lowest thing on my list of priorities!!! Where does all our money go????

HOA's do serve a valuable purpose, generally protecting property values and maintaining a certain level of order and style for all the owners benefits. Having lived in my neighborhood for 18 years I have seen ours swing to extremes depending upon who the current officers are. Our current officers want to legislate our lives and seem to be on a power trip. So most of us just ignore them and hope they will go away.

BTW that was a great story on WRAL tonight. Way to make a difference.

The only good HOA is a dead HOA. I'd rather live in a singlewide on my own piece of property in the country than ever live where there is a HOA

I am of the opinion that HOA's should be declared unconstitutional and outlawed and banned in the USA. We were planning to make some flowerbeds and landscape our yard--nothing major. We had a load of topsoil delivered to our backyard. We planned to work in the evenings and all day on Saturday to complete our project--a total of 4 days. One hour after the load of topsoil was delivered, the HOA president was in our yard telling us we had 24 hours to remove this "unsitely" pile of dirt or be fined $25 per day until the dirt was disbursed. We had to just spread the dirt out over our backyard and seed over it to avoid the fine. We have had nothing but grief with our HOA. This is the first home we have ever lived in that was governed by an HOA. When we move, the first question I will ask is if there is a HOA and if so I will not buy the home. I will never live in another home governed by an HOA. You have no rights and some of the officers in the HOA love to flaunt their powers.

Sounds like you cant afford to live on that side of town.

I love living in an HOA neighhborhood. I came from a neighborhood without one and didn't like the anything goes situations it created. I like that mine makes you get approval before you put up a fence or change anything. I like that dogs arent allowed in a yard unless you're with them - I don't want to hear dogs barking all day or night. I like that they send out a notice if you leave your trash can out front or dont take care of your yard.

I was so horrified at what my HOA was doing to my 91 year old neighbor (sending him threatening letters for something a prior board had expressly authorized), that I went to my local State rep. He sponsored a bill and I went to the State house to testify in support of this bill. There were dozens of other homeowners too. Guess who killed the bill???? NOT OTHER HOMEOWNERS!!! Lawyers and property managers acutaly have a lobby, the Community Associations Institute and they do not allow a single law to be passed that would keep them out of our pockets! When some idiot finds a weed on your lawn and begins the fine/legal fees/forclosure process, this is MONEY IN THE BANK FOR THE LAWYERS!. We are cows being milked by this 'industry', and we are treated with as much respect.

This is more my parents story than mine- and Angela will appreciation this FL story. My parents liked in Coral Springs Fl before we moved to Lake Worth. Coral Springs had a town ordinance and the community that they lived in had a HOA. Both stated no trucks in the yard, driveway, etc. Well- with a 1 car garage, which is where Mom had HER car, things got tricky and Dad got smart. He built a 5 ft privacy wall all around their property. His truck was just a little pick up truck, so it wasn't an eye sore anyway. But he just pulled into the driveway, then drove it around to the inside of the walls. The neighbors laughed as they couldn't imagine him getting in trouble for this little truck. But he was bound and determined not to get caught. And he never did get caught! This was in the mid 70's.

We live in Timberlake Meadows in Timberlake, NC. We have an unusual problem. We cant get our developers(who run the hoa) to follow their own rules that they wrote. Willis Parker(builder and part owner of Diamond Development) built a house in our neighborhood which sat unocupied for year and a half or 2. He finally sold it and since selling it he has allowed this homeowner to put a storage building in the front/side yard instead of the back where he told everyone else to put theirs, he allows them to pile their garbage beside this along with their Christmas tree from January and old tires, etc..., has allowed them to put a privacy fence on OUR property and on the neighbor's property on the other side, let them put a totally different style fence between their house and a nighbor's, lets them not maintain the fences which after 2 yrs looks like it is about to fall down, and allows them to have 7 dogs instead of the 2 allowed by covenants

Oops. And when they said no they were asked to mulch!

I've decided that the only thing hoa's are good for is generating $ for lawn services and creating distance between neighbors.

Obviously I could go on and on!

I do live in a subdivision, but we don't have an HOA. Most of us are pretty good about keeping our lawns maintained and not "trashing the place up", so I don't worry about property values going down. I can't stand the thought that someone would tell me what I could or couldn't do. I pay the mortgage, I get to make the decisions.

gotarheels100, you actually have a very good court case. I don't think you can sue the HOA, but you can sue your neighbor. If their fence is on your property, sue them. If they are violating the conveants, you and other neighbors can sue the homeowner. I'm sure there are lawyers out there who would love to take on your case.

Fuqua resident, Thanks for the comment. Some of our homeowners had a meeting this weekend. We are talking about getting a lawyer involved. Hoping i can get 5 on your side involved. Working on that now. Think a phone call from them might scare them a little and maybe they would start following their rules. Hope so anyway. Tired of having to pay money out of my pocket when they should follow their own rules. Thanks If anybody else has anything that could help us please let me know.

HOA's are horrible! Some of the folks I live around can be a real B*&%h! I have a few horror stories. Like the lady that puts big orange stickers on front windshields if she doesn't like where you've parked so you can be towed. (President of our HOA) Or the one that yells that she will report you to the board if you play with your kids in the pool during the day because she works from home and is the pool manager. They abuse the be-geezus out of their power.

Avoid Fred Smith communities if you do not like HOA's. We have not seen one rule enforced yet since we have lived here. We pay hefty due for what??!!? Our entire board is developers and NO homeowners, so we have NO say in anything. If there are things residents are able to do legally, I would love to know!

Beyond our back fence was wooded with greenway, sewer and basin easements. The Reserve HOA sent us a letter demanding that we "weed" the "natural" area behind our fence. We had to point out the page in their bylaws that stated that homeowners were not to disturb easements. None of the other wooded areas in the community were "weeded", including property owned by the HOA. It was just another bogus, erroneous, libelous letter that the HOA is known for.

I have a horror story about TLC Management. They have an office in Raleigh. This company shares an office with Anderson Homes and their employees actually work for and have email addresses with the Anderson Homes' extension. I watched every year as they found ways to take all of our dues money and leave us with less than $500. A closer look at the financial records showed numerous payments going to Anderson Homes after they had completely left the neighborhood and mysterious amount of lawyer fees going out but not coming back in when the fees were paid. They hired the landscaping who did nothing and ended up being related to one of the TLC employees. They refused to acknowledge our properly elected officers. I contacted 5 on your side and the Durham county DA office and was referred to a lawyer to help. I paid this lawyer out of my own pocket. TLC ignored all the notices and dared me to pay thousands to take them to court. Truly corrupt people with the company.

I would NEVER purchase property in a neighborhood with an HOA, with restrictive covenants, or worse yet, in CARY, NC. Wake County zoning and permit requirements are too restrictive as it is!

I have been having HUGE problems with my HOA over the last year. First off, a company bought the condo right next to my house. I found out that they were planning on using it to "house" guests as they come in and out of town. Therefore, there would multiple people coming and going at all hours. I informed Homeowners when I was made aware, as it's against the convenence for a company to buy property in our neighborhood with intentions of operating it like an Extended Stay America. Homeowners said they would take care of it but I found out that after they had their lawyer draft a letter to the owner of the property but never followed up again. I have asked HOA reps to please follow up but the subject keeps getting pushed to the side.

They just don't want to deal with it....so they don't. I love my neighborhood and I love my neighbors (ok most of them) but I HATE HATE HATE dealing with my HOA. I don't spend $200/month for things not to be taken care of.

Why is it that developers are allowed to maintain an HOA for as long as they are? I find it against a lot of state's collusion laws that these developers are allowed to bring their friends in and manage the services of the HOA as opposed to putting them out to bid like you should to get the best services and rates. I live in a community where the developer is only interested in putting more and more housing in without regards for public safety and basic services such as water or parking. We don't have an HOA to fight for us because it IS the developer and every positive action that has taken place has been as a result of the owners actions directly with the city. Everything looking the same and conforming to someone else's ideas of what is acceptable or not, do not make a community. Communities are made by those who live in them, not regulations.

I would vote make HOA's illegal immediately. You just need a 3rd party system to manage the funds.

I live in a HOA subdivision and I hate it. Why do I need to get my neighbor to sign off on my plans to have a fence put up? When I had my house built, the builders would have gladly built it for an additional cost of 5,000 dollars. It just does not make a lot of sense to me. If I follow the rules of the covenant that should be good enough.

Ok. This one in Cary will top it all. Sending threatening letters to homeowners who are already defaulting on their mortgages in an attempt to foreclose and beat the lender in the game. All for how much? A few hundred dollars in missed assessments. Cost of a foreclosure - about $2400. No payment plans were discussed. The HOA wants to enforce absurd appearance guidelines for home & yards in the name of "Pride of homeownership". Oh, they extend favors to their friends. They violate the architectural guidelines and approve ARC requests for their friends. No financial transparency. The management firms are a parasite.HOAs are about power/control/fines and foreclosure.It unfortunately attracts control freaks. They will deny you your rights under federal laws and get away with it if they think that you will not standup. They rule by threatening and unfortunately for most people it is easier to move than fight.Secrecy of operation is their world.

We have problems in HOA problems. Last year we the homeowners approved a budget. It included cost for specific items for landscaping. We have not received them this year since special projects the board wanted were done instead. Can HOA BOD's spend money on projects other than those approved in the budget? What do we do to get the landscaping services that were in the budget but yet to appear? Our management company isn't good either. They look out for special interest and do not look out for the financial well being of the neighborhood. They are a large co. in Raleigh and get many new builder accounts. Once the builder is out forget the homeowners. How can we get them to manage our money well and be held accountable for our budget?

Do not buy in Sandy Springs in Fuquay. The HOA-Omega Management has a group of ignorant people working for them. I got a letter earlier last month telling me I was in violation of the covenants-specifically my yard needed to be mowed. I keep my yard VERY well manicured--VERY WELL. I called them on it and asked who was responsible for going around the neighborhood checking on this stuff. It was the lady I was speaking with. I told her she needed to have her eyes checked and that I was owed an apology. I'm still waiting on that. Meanwhile, my next door neighbors grass is azz hole deep to an elephant, and they have never run an edger in the two years they have lived there.

Our HOA does not allow us hang any flags in the front of our yard. We cannot have any tables, chairs, decoration of any kind and trees have to be approved. Fence has to be the same like everyone elses. If you have problems with neighbours who rent and making a mess, it's not their problem and you should call the police. I have such a regrets moving into this subdivision and hopefully will be able to sell my home when economy improves. Feeling like a slave in your own home is not healthy.

Not everyone has the same priorities. My yard is pretty low on my list of priorities. I do what I have to do to follow the rules of my HOA. My neighbors around the corner have their yard higher on their list of priorities. I think they apprecitate the fact that there are rules to keep people like me from bumping my yard down the list a few notches.

Seriously, it is hard to avoid HOA's but if you have a choice definitely stay away from RS Fincher. Many local companies will not work with communities that are "managed" by RS Fincher. Their incompetent, libelous and nasty correspondence comes with bible quotes. How insane!

The property management firms are a business. They need to have strong HOAs to be parasites. They do things because the bums on your board have asked them to do. Pay close attention to the monthly finances. Make sure your board operates according to the bylaws and the covenants. Talk to your neighbors in the community. Build consensus. Make sure that your board operates and implements best practises. The HOAs were instituted with a good goal, but has had no oversight. Its a quasi government with no control framework. If the HOA sues you, they will need to spend the money. check if your community is governed by the NC planned community act. If you sue the HOA, their liabiltiy insurance will kick in and will only shield if they are not at fault as determined by the insurance firm. Removing the board members and putting reasonable smart people is the way to go. Apathy is a big issue. Don't buy into the nonsense about property values and your neighbors yard.

People buy homes because of good safe location, proximity to amneties, good schools and short commutes. They don't walk away from a home because a neighbor has a yard that is not manicured. In fact, having a lenient HOA will attract more people friendly homeowners. Also the major issue appears to be that people use the HOA as a means to enforce their opinion on their neighbors free land use rights. People don't realize that life is short. In several parts of Durham, you will be dead the next day for doing stuff like that,ie Snitching for the HOA. Oh, there is going to be another round of battle brewing in the next few years. rainbarrels,solar panels,windmills,outdoor TV antennas for HDTV. Strong rules governing a HOA board and its operation needs to be enacted by the NC state government. A regulatory agency like the attorney generals office will need to be vested with the enforcement power. Hold board members accountable for wrong doing.

My HOA is CAS (Community Association Services). is telling us that we don't have money to do extra things with. How can they get away with this. I still say an indepedent auditor needs to come and take a look at the books b/c you can not tell me that 23,000 is missing. These people are crooks. Now below is what we are being subjected to because of this HOA

The committee is very interested in holding the Christmas social again this year, but since we cannot take monies from the budget we are asking for people to donate $5.00 per family member. Children under 3 years will be allowed to eat free and those 4 years and up will pay.

Budget Oversight Committee This committee will be meeting to discuss this years budget and plan for next year. We are ($23 000.00) twenty three thousand dollars in the red, and we want to come up with ideas on how to get out of debt. They took the actual home owners money and PAID for the townhouse dues and that left the home owners in the red!!

For the person that got shut out from displaying the American flag, check if there is wording in your covenants that "NO American flag will be allowed for display". If this language is explicitly missing, you should most likely be ok in putting up one. Check the NC planned community act. Google for it. How dare they disallow the display of an American flag in a free country. Bums.
