why me?

Ok, have you ever had one of those days when you feel like the universe is out to destroy you? Well today is my day.  Monday's are usually bad, but this one takes the cake.  I started off on the wrong foot, and it's been a train wreck ever since.  At this point I would love to go curl up in a ball in my bed and start over again tomorrow.

 

For one of my cluster-f's today I need some audience participation.

QUESTION:  Has anyone here ever been sued because someone hurt themselves on your property?  I had a very intoxicated houseguest Saturday night and she fell off my daugther's trampoline and broke a rib.  She mentioned semi-jokingly several times Sunday that she was gonna sue me.  Well since she got confirmation today that she is officially "broken" I'm afraid that all joking has been set aside and she's angry.  I think she really is gonna sue me.  ***We're renting, so no homeowners insurance**

With the way my day has gone, I'm not suprised. 

Would ya'll call a lawyer, or just sit tight and wait to see what comes?

I would talk to your Sister in law and see if you can get a bead on this gal - she clearly is not the sharpest tool in the shed and perhaps SIL can talk her out of doing anything foolish - like suing YOU for her own stupidity.

I seriously don't think she will want the hassle. First, you have no homeowners. It is much easier to go after someone with homeowners insurance. If she does sue, it will be for reimbursement of medical. As for getting anything for pain and suffering, that is very unlikely, as her injuries were not life threatening (assuming the rib didn't puncture an organ). She was, after all, drinking before she arrived at your home and is an adult. And my guess is that sister in law would be very upset with her if she did sue. I would hold off on contacting the lawyer until I heard that she had filed suit. Good luck and friendly hugs for the bad day! :)

P.S. That is insane that someone would try to blame you for this.....people don't have any sense of responsibility anymore.

That sucks. I am sorry for you, and I think those are right in saying you should at the very least consult with a lawyer.

I'm with Hanker...No one made her get up and act the fool. Why is it your fault? I would contact a lawyer just to get the skinny on what your rights are. Good luck!!

That is one of the craziest things I have ever heard. Maybe if she wasnt drunk she wouldnt have fallen. I personally dont think she will have a leg to stand on if this should be taken to court, not unless she was drinking at your house.

I wouldn't necessarily retain an attorney just yet. No point in spending that money if you don't need to. There are some law offices that will give you an hours worth of time for free (first meeting). Ask them if you have anything to worry about.

My personal opinion is that she won't have a leg to stand on with this. She's an adult and responsible for her own actions. I realize that people can sue a homeowner if they get hurt on that property, but that doens't mean they WIN those suits.

Good luck. She sounds like a selfish idiot who doesn't deserve to have you as a friend.

girl! i am so sorry...i hope she doesnt sue you! its her fault that she chose to drink and get on the trampoline...not yours! a true friend wouldnt do that

Since she was drunk, didn't she hear you tell her several times to stay away from the trampoline? One thing I know, drunks get deaf. She probably can't remember, right?
