What part of what I said are you disagreeing with, specifically why, and what is your alternative explanation / opinion?

Why would it? As of now, the merits of the petition haven't been considered or ruled upon by any court. Even when they are, who's going to objectively testify to its validity? She can't. She's dead.
The parents have a vested emotional interest in getting the kids, so the truth of anything they allege has to be viewed with that in consideration. Likewise the sister.
He, on the other hand, has a vested interest in keeping his children.
Meanwhile, none of these allegations have been validated or substantiated, and if you know anything about custody battles, people will do or say pretty much whatever is required to win them.
There's much more here that is unknown than what is known.

At this point in the thing, any or all of them could potentially be lying. We don't know enough to take any of them at face value.
