Published Jun. 9, 2008As I was driving up Market street in Smithfield heading toward the courthouse, I was feeling pretty uneasy about the whole thing, my stomach was all tied up in knots. I hit the left turn lane in front of the courthouse and she pulled in behind me ( how's that for timing?) I parked my car a few blocks away because it was a madhouse there with that woman being on trial for murdering her son. She parked a few cars behind me and got out, walking quickly towards the courthouse. I followed behind her. She didn't seem to want to acknowledge that I was there. We got to the information desk and she asks where to go, I followed her to the area where the divorce court is being held. I sidled up beside her by the door and said " hey there!" We went inside and I sat right next to her. They began announcing all the cases, the usual courtroom stuff. We had some idle chitchat, she told me that my step-daughter had tonsil/adenoid surgery and wasn't doing so well. ( I knew about the surgery because I text messaged my daughter last night) well, she may not make the graduation because of this - I was planning to go. She then wrote me a note asking if I was there to contest the divorce and handed me the pad. I wrote her back that I wasn't contesting, I was there to make sure she didn't pull a fast one - besides we started this together, we're going to end it together! By this time, listening to all the drama, I leaned over to her and said I was glad we didn't have the problems these other people had! About an hour and a half go by before they finally call her up to hear the case - what I heard next absolutely stunned me! The judge looked at her and said, "Mrs. Finkelstein, you filed this complaint on April 24th, 2008, but your complaint says the date of separation was May 1st, 2007. It has not been a full year and I'm afraid I'm going to have to dismiss your case." I was torn between being really pizzed, and busting out laughing - I was irritated that I wasted two hours away from work for nothing. She just about burst into tears. I think it was all she could do not to cry. I had to fight the urge to comfort her ( instinct of a husband seeing his wife so upset, hard to choke that down.) She evidentially spent $300.00 on filing the divorce and said she didn't have the money to file again. She had two recent oral surgeries and my daughter had her operation last week. I told her I was sorry, I didn't have it either. (she booted me out, it's not my problem anymore)We walked to our vehicles not saying a word. I got in my car and started it and then she beeped my nextel. She wanted me to go back in because some sheriff friend of hers told her she could get a form claiming she cant pay again (indigent)and maybe they'd serve me papers right there on the spot. Well, I walked back in with her and basically they told her the entire case was dismissed. She has to fill out all new paperwork, come to my office to get the papers signed and notarized (again) take the papers to the courthouse and file them (again) have me served(again) and then after I'm served, she has to wait a full 30 days before they will give her another court date.
AHHHHHHHHHHHHSo much for being a free man today. I can't believe she did something so dumb ( she's really not a dumb person) I knew she filed a week early but I guess I thought she must have asked someone at the courthouse when she could file. I guess she though by the time the court date was issued, it would be a full year. WRONG!! the complaint has to be dated 1 full year after the claimed separation date. It's going to be about a month and a half before this will get straightened out and go to court again, IF, and I do mean IF they grant her indigence request. I don't have the money and feel even if I did, she's the one that wants a divorce, she can pay for it. Between the two surgeries she had, the one my step-daughter had, the infection she had, facing more surgery for possible mouth cancer - the surgeon messing up her paperwork for disability. I'm starting to wonder if God is giving her a little spanking, hmm
oh well --ces't la guerre (such is war)
