family suing officer, suspect in crash that killed sisters

Sisters Linsay and Maggie Lunsford were killed when a suspect fleeing from a Franklinton police officer crashed his car head-on into theirs.

 

 

Okay, this story and the posts on WRAL are setting off this thing I always get when tragedies like this occur.

 

I feel so bad for the families and those who loved them, but I just have to ask myself...

 

When are we all going to stop suing the pants off any and everyone?

 

Not saying that they shouldn't be suing in this case, I'm just saying that I think the wealth of lawsuits in this country has much to do with the high costs we pay for a variety of services and goods.

 

I find this trend, which seems to increase every year, very disturbing.

 

Am I the only one that is bothered by this?

I agree, OS. This is essentially Parish v. Hill all over again. I would expect a similar adjudication in this case.

Speed alone is insufficient to establish gross negligence in NC. In motor vehicle cases, it's generally only been found in drunk drivers and prearranged speed competitions. Only once case involving a LEO has ever survived summary judgment on the issue (summary judgement roughly equals being dismissed by the judge): Jones v. City of Durham, after it's third trip to the Court of Appeals. In that case, Jones was traveling 70 miles per hour through the middle of the city at night (and if I recall correctly) with no lights or siren activated.

However, the Court also found the City had sovereign immunity, which was a whole different issue. The case settled before trial.

Sue the man fleeing recklessly, not the officer.

If I had to guess, I'd say that they might possibly have some final expenses to cover. The news stories report that the older daughter was in college... it is possible they still had unpaid expenses resulting from that, even.

I also think that it is highly probable that shady lawyers have come out of the woodwork, and 'well meaning' relatives and friends have urged this grieving family to 'go after the money'.

*sigh*

It is so very sad. I mean, in rocknhorse's case, it makes sense. You are in an accident. Someone else is at fault, and you are injured. Suing for payment of hospital/medical bills, time off work, etc, this is all reasonable compensation when you've been hurt through no fault of your own.

But suing solely for the sake of 'hurting' someone else because you feel they're responsible? I don't get it.

It won't bring back a loved one.

Or even 2, in this case.

*sigh*

Will it bring the girls back? If they are suing for $$$, are they going to build a memorial? Donate it to the schools they attended? No amount will bring them back...The officer was doing his job. Why hurt someone else? I just don't get it...

I'd say gross negligence would be going 30 over the speed limit to go to lunch and hitting and killing 2 people.....

But not in chasing a known criminal.

If the policy is no more than 20 over and the cop was going 30 over, I don't see that as gross negligence. Especially when he was chasing a criminal....
