Yes, but not for PUNITIVE damages. Legally, an employer is not liable for punitives unless the reckless act is a natural part of the person's job - ie: bouncers who get too rough.

Getting drunk was not part of the Captain's job.

river - I'm with you on that...I'm surprised Louisiana or Texas aren't pushing hard for a new refinery there...Louisiana could surely use the jobs

I was asking Tmedlin if the power grids were a concern to her as well. She was commenting on how refineries and power plants have not been built in decades.

guess I'm not doing a very good job of conveying here. Am I against profits? No, of course not. Do I support windfall rofit taxes on grain or anyone else? No, it's a free market. No I do not want to puinish success. I only try to make one point, just one and it goes back to my original post. The US's refining capacity is nowhere near what we require currently and will for the foreseeable future at least till alternative sources become more viable. it would seem to prudent to be working on increasing this before some tyrant in a funny hat decides to turn off the spigot.

river rat - are you against profits? From what I've read, their profit margin has not increased, the huge profits are based on volume sold...are you gonna be for windfall profits taxes against "big grain"? Their profits are at an all-time high, too! What about every other company that makes a profit? I guess I just don't understand why so many people want to punish success, but reward incompetance and sloth... How many employees does ExxonMobile have? How many will lose their jobs when Obama-lama-dingdung imposes his windfall profits tax? How many people will suffer if they raise their prices because of it? How much $ will the govt. lose, if they more their offices off-shore?

Must have stepped on someone's toes there....oh well. No I'm not on Chavez's case(although i do not knowingly buy Citgo products) because I don't expect him to add more refining capacity. I single out ExxonMobil because their mouthpiece has been railing recently about the prohibitive cost of adding refining capacity.

Regarding profits, from the US News and World Report Feb 1 2008: "Exxon Mobil's staggering $40.6 billion earnings for 2007 drive the truth home: There's no business on the planet that gushes forth more profit than selling oil—nothing even close." " Exxon beat its own one-year-old record for the biggest corporate profits ever by 3 percent."

Perhaps you need to check your facts again there, tidbit.

The electrical companies were unable to keep up with demand. Stories were done about how outdated many of our systems were. Is this part of your concern, too? hawk_fan

Is there any doubt in anyone's mind that ExxonMobil is posting record profits? If so, step one would be to crawl out from under the rock that shields you.=the river rat

so come out of that rock then please. And when you do - look up Exxon's profts over the last 20 years. It's public record, so it shouldn't be hard. When you do, you will find that thier profits so far this year and last year ARE NOT records for them. Not in anyway shape or form. To point in fact (since I've already done this myself) their profits are down.

And funny how you only (just like the Democrats and liberal media) only go after Exxon. 1) Exxon has other investments 2) Exxon (because of hard core restriction placed by our gov't) buys 56% of it's oil from foreign entities -i.e How OPEC controls the price. 3) you don't seem to be going after any of the other companies. How about CITGO who DID set record profits and DOES NOT invest in any alternative fuel research! But charge us the same. OH CHavez=hero

De -reagulate the cartels. That would put a competitive position in the market.
