durham da seeks higher bonds on defendants

Published Feb. 13, 2008

Durham County District Attorney David Saacks has proposed dramatically increasing the amounts of bonds local judges set for people charged with crimes. IT has happened time and time again. A person is arrested and taken off the street for a crime and before my paperwork is done they are walking out of the jail and getting back on the street. Time and time again that same person goes out and commits a crime the same night. It does not always happen, but it does happen. More often than not it is because of an unsecure or low bond. Not every crime earns a high end bond, but anything that involves a weapon or violence should get at a minimum a secure bond. In some counties a DUI gets a custody release. What ever happened to getting tough on drunk driving? I personally have struggled with a suspect at a scene, then had to pull my patrol car over resecure him then once at the magistrate office we had to subdue him again. The magistrate said that if we wanted to charge him with resisting arrest to "write it on a citation". Well not to call any names on the magistrate...but it was Wilson county, and the magistrate has the initials of M.B. It is time that violent offenders sit in jail and keep them from harming others. If the court system doesn't do its job then what good is it to have one. There are enough people getting away with crimes because of attorneys finding loop holes in cases. That is their job, but at least keep repeaters put away because history tells us they will repeat again.

If u r going to hold that vigil please let me know i will bring the red hots and soda.

Enolive: I caught the humor, but I wanted to post some seriousness also, i cut and paste the wrong statement before i hit the submit button. Sorry.

Cops Eye, I thought that it would be evident that I was attempting humor with that post. My claim to fame is holding an all night vigil outside Central Prison protesting the death penalty as not being painful enough.

Enolive: The socioeconomic system that contributes to these disenfranchised persons is laziness. There r so many young people today that get a check in the mail for doing nothing. The whole moral fiber, work ethic, respect for others etc., has been watered down with alot of the younger people of today. NOT ALL. A large portion of the crime committed today is by a small percentage of the populace. When the they r permitted to profit well with little consequences then y not keep committing crimes. It is easier than doing the right thing and being productive in society.

imyourhuckleberry: Im curious to know what kind of charge ur friend was hit with for a 10k bond. Especially if it cost 7k to get them out. Ususally a standard 10-15% with a bondsman would get them out.

Tmedlin- u r absolutely right they r people too. We should rehab people,etc...No I can't keep on with that sarcasm...lol. The only point I would like to make is that if someone is committing a violent crime or is a repeat offender then they should definitely be under a higher bond. When I go to work I know there is the possibilty that I could get hurt or have to hurt someone. In no way do I or anyone else wearing a badge go into this line of work wanting or hoping to hurt or kill someone. The whole point of this line of work is to help and protect people in need. We see the same faces over and over in most cases. We are selves wonder when the system is going to hold up its end of the bargain. Raising the bonds is only the first step.

Good blog. A person I know was just arrested and put in Jail for 2 days on unfounded charges. Bail was set at 10k - and ended up paying 7K to get him out. Totally innocent of charges mind you. Reading something like this and knowing people who commit crimes, even in dirtham, walk free is disturbing.

I agree with TMED, also we should first attempt to explore the socio-economic disparities that cause these disenfranchised citizens to go out and perpetrate these ill advised actions. crimes.

awwwww - you know "they are just people, too" what do you mean "repeat offenders" if we would just love them a little more, it would be no problem...we need to rehabilitate, not punish, blah, blah, blah. If I was a LEO, it would tick me off, too! Thank you for your service, and I agree with ALL your comments.
