Girl hit on U.S. 70 has died

— The 12-year-old girl hit by an alleged drunk driver Thursday night on U.S. Highway 70 in Wayne County has died, according to the state Highway Patrol.

Troopers said Heather Weir ran out into traffic and was hit by a pick-up truck driven by James Brooks Jr., 67, of New Bern. Troopers determined that Brooks had been drinking and charged him with driving while impaired.

    Other news sources point out exactly why she was in the highway. This is only half the story

    So sorry that the girl was hit, then died from her injuries. Also feel for the man that hit her as it doesn't appear that his drinking in any way caused the accident. She ran into the road at night. Don't in any way condone the drinking and driving, but in this case doesn't seem it would have mattered in the outcome.

    Sad that the girl died. I feel bad for the man that hit her as well. She ran out into the road late at night. Then the poor man gets the DWI charge. People I hope realize that it could mean that the man was well within the legal limit. Police can charge DWI for even below the legal limit. So I had already seen a comment on the original story of a person stating about "drunk" man. This could have been a man that just had one beer and got charged.
