— A Fort Bragg soldier was arrested Wednesday and charged with second-degree rape.

Michael Fazekas, 20, is accused of raping a 20-year-old woman at a house on Foxlake Drive on Oct. 31, according to Fayetteville police Sgt. J. Somerindyke.

The woman had been drinking and passed out in one of the bedrooms, police said.

"When she woke up, the suspect was on top of her having intercourse without her consent. She screamed and he got off of her, then left the room," Somerindyke said.

Fazekas was being held in jail on a $10,000 bond. No other information was released.

"Ladies don't drink so that you will have a memory of all that happened. Then no one can take advantage of you either."
Wildcat- everyone has the RIGHT to drink and or be drunk without having to fear being raped. It is these type of statements that are victim blaming.

Nice ASSumption woulda. After an investigation and trial it is determined that she in fact did seduce him, even if she was drunk, she should face charges too for false accusations. Drinking too much and leading someone into a bedroom only to pass out and wake up with him on top of you does not constitute rape as we all typically define it. I've seen it happen way too often.

He knew better and knew it was wrong to take advantage of her in that way. It was clear rape because she was not of herself and did not give him permission. Send him to prison and maybe there he will learn a valuable lesson of taking advantage of others, especially women. I do hope the girl will be OK and should be reminded not to by alone by herself in certain circumstances.
