— Fayetteville police arrested an 18-year-old Tuesday after they found an airsoft pistol, a .32-caliber handgun and marijuana in his car, authorities said.

An officer stopped a 1998 Chevrolet Camaro around 6 p.m. at Tokay Park on Hamilton Street and noticed what appeared to be a gun in the back seat, according to police.

The officer arrested the driver, Oshay Delon Rayshaun Jackson, of the 6200 block of Whitehall Drive, and charged him with carrying a concealed weapon without a permit and possession of marijuana, both of which are misdemeanors.

He was being held under a $5,000 secured bond. No other information was released.

The local paper reported that the weapon the partolman saw turned out to be an air gun of some sort but that the ensuing search led to the concealed .32. I wonder if if this was a consent search?

michaelclay, I was partialy correct about the age. In some counties in NC you can obtain a permit at age 18 and can purchase a handgun from another individual. A federaly licensed dealer can not sell to anyone under 21.

michaelclay, you have to be 21 years of age to purchase handguns in the state of North Carolina. They can purchase longguns at age 18.

If the officer could see the firearm from outside the vehicle it was not concealed. I know of two other cases where officers made the same charge and both cases were thrown out of court. Fayetteville police do not respect the rights of citizens allowed under the constitution.

kilpatrick79, you only have to be 18 to legally purchase a hand gun in the state of NC.

A lot of misinformation on this page. Persons 18-21 years of age can legally purchase and openly carry a handgun in NC. While I'm 21 more and do have my CHP, I did obtain one handgun purchase permit from my sheriff at 19 and one at 20. Still have the permit to prove it.

Carrying concealed without a permit is a misdemeanor for the first conviction, and a felony after that. What does it matter anyway? It's not like he would serve any time our that catching a felony would keep him from buying a gun illegally or carrying it illegally.

Yup. Not allowed to carry a handgun, even a legally obtained one if you're under 21. Of course the penalty isn't as stiff. He wouldn't be doing some time if it was a stolen, or illegally obtained gun and he had it while selling the pot. Messed up laws in a way.

This guy was arrested for concealing his weapon, not concealing an illegal weapon... That is a misd.... however, the mary jane is a whole different story. Being under the influence of drugs and then having a weapon period is not good...

  • kilpatrick79 Jan 25, 2012

NCCaryguy, it may not have been an illegal gun, but he had to have gotten it illegaly because he is only 18. State and Federal law requires you to b 21 to purchase a handgun.

That is a crazy law allowing a concealed weapon and only a misdemeaner charge. But then again, the bad guys do not care. Thank goodness for CCW permits for the good guys !
