Fayetteville man arrested for second-degree murder

— Fayetteville police arrested Tuscan A. Carter, 26, Wednesday and charged him with second-degree murder in the death of James Christopher Diggs.

Diggs's body was found at the intersection of Eastern Boulevard and Grove Street in Fayetteville on Sunday. he was 42.

Police have asked that anyone with information about Diggs' next of kin call 910-433-1421.

    colliedave: This was likely a drug deal gone bad. That's likely considered a spontaneous murder, not premeditated. That makes it 2nd degree murder at best - even if the drug deal constituted a felony. Felony murder (if NC prosecutes "felony" murder) usually does not rise to the level of 1st degree murder without a some sort of extenuating/special circumstances.

    Given what is currently going on with NC's death row and the "race bias" stuff going on at the same time, I can see a lot of 2nd degree murder charges on the horizon. Easier to convict and easier to uphold upon appeal.

    And what was the connection between the two guys and why second degree murder and not first degree murder? Do the WRAL reporters ask the police department's public information officer any questions? Or, do they simple post what the deparrment releases?
