Durham officials have agreed to pay $300,000 to settle a wrongful death lawsuit filed by the family of a man killed three years ago by a street sweeper.

DURHAM, N.C. — City officials have agreed to pay $300,000 to settle a wrongful death lawsuit filed by the family of a man killed three years ago by a street sweeper.

Marvin Miller Martin, 82, was walking toward his Higbee Street home on Nov. 13, 2006, when a city street sweeper operated by Penny Moore backed up and hit him, authorities said.

Moore, who has worked for the city's Solid Waste Department since 1997, was cleared of any criminal wrongdoing in the incident.
