Durham businessman accused of tax fraud

Posted January 28, 2011

— A Durham businessman has been accused of tax fraud by the North Carolina Department of Revenue.

Tyrone Tyree Irby, 45, of 5150 Revere Road, faces six counts of willful failure to file return, supply information or pay tax.

Revenue department investigators believe that Irby failed to file and pay his tax returns from 2004 to 2009, department spokeswoman Beth Stevenson stated.

Irby is listed as the owner of Choice Personal Fitness and Up in Smoke Catering on the companies' website.

He was placed in the Wake County jail Thursday under a $10,000 secured bond. His first court appearance was set for March 7.

@fatchance, the guy created and ran two different businesses for several years. Maybe he’s broke and desperate. C’mon...we all know why you assume he’s uneducated... In any case, our jails of full of smart & educated people.

@hereandnow99: Uneducated as in not posessing sufficient knowledge of how to run a business properly and within the law.

Uneducated as in not posessing the common sense to know that not paying his taxes would ruin his business.

Uneducated as in not posessing sufficient knowledge of the tax laws and repercussions of violating them.

Oh, were you talking about his highschool or college education level? I wasn't. Funny how you can assume something incorrectly, huh.

@fatchance, how do you know about this man's education level? Some people don’t pay taxes because they’re making a political statement.

  • fatchanceimwrong Jan 28, 2011

This is what happens when uneducated folk try to go into business.

What, Something illegal being done in DURHAM. How odd. How strange. This just can't be true, Durhan is such an honest city.

It's funny. This guy files no return, which means he has no reported income. Which means his kids qualify for free lunch, and he qualifies for government assistance. On my tax dollar, which I lawfully reported. And people want to say "Ignore the small fries????"

I reported a white man for not paying his taxes here...they never did anything. Owes a lot more than this guy too!!

  • we_all_have_it_coming Jan 28, 2011

"Surely not, according to one commenter on here a few weeks back only white business men were thieves."

Truth be known - there is a disconcerting number of black-owned businesses that have tax problems and/or owe back taxes. Google it.

    I guess he's a Wesley Snipes fan.

Fraud is fraud and, yet, so long as the focus in on the little guys like this, the spotlight will stay off the real problems in the Tax Code and the tax system of the U.S.
