Duke student's accused killer seeks to move trial

— The attorney for the man accused of killing a Duke University graduate student five years ago wants his trial moved out of Durham.

Laurence Lovette is accused of robbing and killing Abhijit Mahato in January 2008.

In newly filed court documents, Lovette's attorney claims he can't get a fair trial due to inflammatory and prejudicial media coverage.

Lovette is already serving a life sentence for the March 2008 murder of University of North Carolina at Chapel Hill student body president Eve Carson.

Other motions filed on Lovette's behalf request questioning potential jurors individually and blocking prosecutors from using any statements made by Lovette. The defense also wants to know if prosecutors cut any deals with Stephen Lavance Oates, who had been charged in Mahato's death before those charges were dropped in February.

Lovette is expected in court next week. A trial date hasn't been set.

    If the trial were to be moved to Florida, he most certainly would be found not guilty.

    He is in prison for life, what does he care what the outcome will be for this trial? This is not a request on his behalf, this is a request on the behalf of his family that lives in and around Durham, who want to limit the media coverage and the effect it will have on their lives. Their lives deserve the same amount of respect that they tought this individual about others lives. NONE!!......look deeper

    I was all with you until that last statement which I find to be grossly ignorant. His family hasn't committed any crime and you don't know what they taught him growing up. I sure it wasn't to go out and steal and murder. He commited these crimes; yet you think his family should suffer.

    There are much worse places to have a trial (if you are a defendant) than Durham county. Be careful what you ask for........

    waste of time, space, money, and air. I don't care where he came from, who raised him, or what "adversity" he faced. He's full of hate, greed, and evil and should face the same swift, equal fate as his victim(s)

    He's already got life without possibility of parole. Why even go to the expense of a trial if he will never walk free again anyway.

    He can't get the death penalty because of his age. I still find it hard to believe that someone his age could do the things he has been accused and convicted of.
