RALEIGH, N.C. — The state Court of Appeals rejected a motion Tuesday for a man sentenced for his role in a fatal accident nearly three years ago.

Anderson Sheldon Hazelwood killed his girlfriend, 26-year-old Shavonda Renee Commissiong, and her 5-year-old son, Jalien, in a car crash off Leesville Road during a car chase on Oct. 23, 2004.

Authorities said Hazelwood's vehicle was going 100 mph in a 35 mph zone. Hazelwood blames the accident on a chase.

The Highway Patrol denies the claim and said Hazelwood sped away after being stopped and a trooper discovered marijuana in his vehicle.

Hazelwood, who was convicted of second degree murder and speeding, was sentenced to more than 38 years in prison.
