Cary man, 18, charged with rape

— Cary police arrested an 18-year-old man early Tuesday and charged him with second-degree rape, possession of stolen goods, carrying a concealed gun and resisting an officer.

Dustin Leavitt, of 1657 Glengarry Drive, was being held on a $305,000 bond. The rape allegedly happened at the end of March or beginning of April and was reported on April 24.

Police said they went to Leavitt's house Monday night and he took off with a gun. They eventually captured him in his backyard early Tuesday. No other details were released.

    tmh1375, I don't think it's age. The NC laws consider the fact that a person 18 years and 14 years old are very close in age and might even be two kids in the same high school.

    Statute § 14‑27.7A appears to allow for an age difference of 4 years. So, it may not be statutory rape. But, perhaps he's 4 years and a day older?

    It would be sad, though, to think a young person would be forever marked as a sex offender when they're two kids from the same high school that were dating. Unfortunately, that happens a lot. Our laws are broken.

    My favorite "stupid" law in NC is the one that makes it illegal to wear a mask. Shall we round up all adults on Halloween and put them in jail?     There was nothing in the WRAL article about the victim's age or about her even being a minor. I realize now that the N&O reported the story differently, but there is nothing insensitive about thinking it strange that there was a month between the rape and the report. It was a justifiable comment about a news article.

    Duke LaCrosse - you think there would be a lesson learned there somewhere.. but the simplistic minds of golo strike again. And NO.., I am not saying I think the guy is guilty or innocent. I HAVE NO CLUE!!!! I wasn't there, how could I? But you golo-ers.. man.. you have ALL the answers. (wrong 'answers' mind you, but 'answers' nontheless)

    Is statutory rape considered second degree? Some statutory rape accusations are well warranted, but an 18 yr. old and a 17 or 16 year old is ridiculous.

    If people could actually believe and follow our country's premise that someone is "innocent until proven guilty in a court of law"....then there'd be no "reputation tarnished" or "life ruined" by revealing names of alledged perps.
