Raleigh, N.C. — Rep. Mark Brody, R-Union, and three fellow Republicans have filled a bill that would put a moratorium on a state program that issues licenses to some drivers who are in the U.S. illegally.
State transportation officials have announced they will start issuing driver’s licenses and ID cards on March 25 to some people who entered the country illegally. Created by a presidential executive order, the Deferred Action for Childhood Arrivals program blocks deportation of and grants work permits to those who were brought to the country illegally as young children.
House Bill 141 would put the state license program on hold until at least June 15.
"The executive order is controversial," Brody said Thursday morning. "We had no say in it."
The legislature, he said, should have time to study the matter and submit bills address the program.
One possibility, he said, would be that supporters of the program might file a bill to redesign the license. As currently announced, identity cards issued to those in the DACA program would be vertical, expire on the date their deferral period ends and carry a message indicating that it confers no legal status upon the holder.
“North Carolina should not be making it harder for aspiring citizens to integrate and contribute to our communities by branding them with a second-class driver’s license,” Raul Pinto, a lawyer with the ACLU, said in a news release.
The release wasn't issued in response to the pending legislation.
The moratorium, Brody said, could also give opponents of issuing the special licenses time to pass a bill instructing Division of Motor Vehicles to end the practice entirely.
"It doesn't set any policy whatsoever. It just gives everybody time to look at it," Brody said.

not under current law set to go into effect on march 25. illegals would get a license that looked just like anybody else's. the proposed law discussed in this article delays the enactment of that law by two months so that time would be allowed to consider various alternatives, including the vertical license alternative that you mentioned.

These licenses will be vertical, not horizontal, and clearly state that the holder is an illegal alien and that they convey nothing but driving privileges.

In 10 years it won't be an issue any way since the immigrant populations will sway any votes that come up.

let's go ahead and clear the air about a critical component of the daca program. under this program, state's can legally continue to establish laws regarding eligibility for certain state benefits. one of those benefits are drivers licenses. north carolina is operating perfectly within the law if we decide to deny drivers licenses. - golorealist
Thank you for clarifying that, Obama's Executive order has NOTHING to do with states granting drivers licenses.

they didn't wake up at age 2 and go "I'm a gonna break me some laws today!" and sneak into the country of their own initiative.
these are kids who grew up here. Deporting them would be sending them to a country they've never known and don't know anyone in, and in some cases don't even speak the language.

Indicate on the provisional license its limited duration and that it does not constitute any legality or rights beyond driving privilege.
Even O'bama's amnesty by royal decree only defers prosecution, it does not change their status.

Bentiez was charged with driving with a revoked license, passing a stopped school bus and having unsafe tires.

Yes there is...they are citizens of another sovereign nation who have displayed NO inclination to respect some very basic laws of ours. If they wish to have a driver's license I suggest they get one from whatever country they have steadfastly maintained their allegiance to.
North Carolina should be under no obligation to issue ID to the citizens (legal residents) of any other country...just like they do not issue them to residents of other states!

junkmail5............the government program you're referring to is run/maintained by the same government that seems to be allowing illegal aliens to enter this country illegally. Thus, in my opinion, no government program equates or overrules a court of law proceeding over the case of someone breaking the law. From that perspective, yeah, i've decided on my opinion. If you want to support illegal immigration, that's fine with me. I'm just one of many who don't.

Your understanding of the power and authority of the Executive Branch is obviously limited.
This is NOT a "program"...it is not a the LAW OF THE LAND...but instead an EXECUTIVE ORDER requiring certain federal employees to IGNORE THE LAW OF THE LAND under specified conditions and for a specified period of time.
The immigration status of these people remains that of ILLEGAL and in 2 years when the EXECUTIVE ORDER expires Immigration Enforcement will no longer ignore the law, as per the Executive Order!
