Audit: Overtime improperly paid to Medicaid managers

A dozen Department of Health and Human Services employees improperly collected $580,758 in overtime over the last five years while working to upgrade a Medicaid billing system, according to a state audit released Thursday.

Angie Sligh, the program director for the Medicaid Management Information System, or MMIS, collected 41 percent of the overtime paid out, according to the audit. Eight other managers collected another 47 percent of the overtime, while three rank-and-file employees collected the remaining 12 percent.

"That is a lot of money, and almost half of it went to one person," State Auditor Beth Wood said. "I would say it's fair to call this abusive, (an) abuse of the system."

DHHS obtained verbal approval from the Office of State Personnel to pay the overtime to "regular staff" who otherwise were prohibited from receiving pay for extra hours worked, according to the audit. The agency bolstered its argument for the overtime by noting that the federal government would pick up the bulk of the costs and that speeding the MMIS implementation would eventually save the state money.

The lack of documentation about the exception to state personnel rules meant no controls were in place to monitor the payments, according to the audit.

"Prohibiting overtime pay for exempt employees provides for better control and management of the state’s and agencies’ budgets. Consequently, it is imperative that any exceptions be thoroughly vetted and justified," the audit states.

DHHS even assigned someone to manually enter the overtime into the state's payroll system because the system could account for the overtime since there was no record of it being approved, according to the audit. There is no way to determine if the times and amounts were entered correctly or the cost of using state personnel to handle the task.

The MMIS implementation didn't meet its 2011 deadline – DHHS officials have said it will be online this July – so the employees continued to collect overtime until last month, when new agency officials learned of it and stopped the practice, according to the audit.

"Neither one of (the new personnel officials) knew what was going on. Then, you have DHHS over there doing it, so they're not going to run out and tell anybody," Wood said.

The Office of State Personnel adopted new policies and procedures last fall to ensure exceptions to overtime rules are properly documented.

Wood said the case could result in criminal charges if an investigation determines that the employees were paid for time they didn't actually work.

"This whole process was not managed appropriately," she said.

The audit was the second time in about two weeks that an audit has criticized spending in the Medicaid program. Previously, auditors determined that mismanagement and lax oversight led to high administrative costs in the program.

New DHHS Secretary Aldona Wos said in a statement Thursday that she considers the findings to be serious and has "already taken steps to ensure improved accountability within the department."

Department officials declined to say whether any action has been taken against Sligh or any of the other employees who were paid overtime, saying the audit was about policies and procedures, not individuals.

it might surprise the taxpayers to know how much inside help people get from the County offices in "helping" folks get "signed up" for medicaid benefits. Friends helping friends.

Throw them in prison and have them share cells with the WakeMed fraudsters. Then have them be the poster-folk for gov't fraud. Impose zero-tolerance sentencing on "upper level fraud". You'd be amazed how much the gov't would save.

Now if only Ms. Beth Wood could convince the the Honorable Roy Cooper to proceed with a criminal investigation.....mmmmm.

Maybe the Honorable Patrick Lloyd "Pat" McCrory, will convince the AG to proceed with an in depth investigation to terminate the employment of the guilty parties.

Find the mysterious OSP person who supposedly VERBALLY approved the payout. Fire that individual and all exempt persons who dipped into the taxpayers pockets!!!

We, the taxpayers demand retribution for the people responsible for allowing this to ever have happened. They should pay the monies back, lose their jobs and forfeit any future pension and benefit privileges.

Beth Wood came in and ended the Mary Easely "over pay" audit, thinking it was political attack (and it was political buttering of the breat), pressed a republican underling to move on, and had expensive tastes in training, but has come through on others. Let's hope she does her job on all cases. She's hitting homers now with her Lori Morgan hairstyle. I like her when she is digging. She got the Alcohol enforcement on car use. Let's see how politically selective she is in her audits.

No one put anything in writing, so they'll all be able to say they "don't remember" approving this. What more proof do you need that they knew this was wrong? And justifying it by saying they're stealing our federal tax money as opposed to our state tax money? Fire all of them today, attach bank accounts, garnish wages, no benefits.

Good for you. Unfortunately, most people are voting for party and not the person. Goldman got 1.9 million votes and 1.1 million were from people who just voted straight party ticket.

Regretfully, this is only one of the many branches of the NC government departments that are really tainted. I have an acquaintance that is contracting with a branch of the state now, which I will not mention, and from what this person says, there is so much waste and repetitive work doing things that should not even be done that is is amazing. Not to mention the so called 'management' seems to think they are above 'being terminated' because they have 'to much dirt' on the higher ups! I think these audits need to be conducted all the way through every single branch of the NC government run areas!

So that 41% came up to almost 240,000 spread out over 5 years for Sligh. Really nice bonus huh? Must be nice to be part of the "in crowd".

As an Exempt DHHS employee I am outraged. I work overtime without compensation as many employees I work with do. If this was not approved they need to go after these employees. If it was approved they need to go after the person approving this. Either way it's corruption and abuse in a medicaid system that is already way overbudget.

Employee handbook states:

COMPENSATORY AND OVERTIME PAY/WORK There are two categories of state employees under the Fair Labor Standards Act (FLSA): those who are subject to the overtime compensation provisions of the federal FLSA and others who are exempt from these provisions. If you are an FLSA subject employee and work more than 40 hours in a week, you will either be given time off or be paid for the overtime. Both time off and pay are at a rate of one and a half hours for each hour worked over 40 in a week. The state normally gives time off. Your supervisormust authorize all overtime in advance.

The executive, administrative and professional employees who are exempt from these provisions are not paid overtime compensation but sometimes have more flexible work schedules.

Can someone explain how a state worker is allowed to work from home in the Raleigh area. I can understand in a remote county or if someone needs to stay home for a day or two with a sick child. However, when the citizens of the state are paying for office space why are state employyes allowed to work at home I would think this is a very inefficent use of resources. Comments are this site show that this is being abused.

The point was that it didn't have to be mentioned. Dr. Wos is making a lot of assumptions and lumping all 14,000+ DHHS employees together in her assessments.

Not a smart move. She's complaining about how she can't fill positions. Geez, I wonder why folks are rushing to work for someone who demeans them publicly and assumes the worst about them. Add that to the low pay and non-existent raises...

Ms.B. had many previous audits, but nothing became of it. Maybe it's like the Penn State Paterno findings... report to upper management (governor Perdue) and it disappears. Our new governor needs to put some teeth in these serious reports. I know of $580k we can put back into the NC revenue stream.

Not to my knowledge. I'm not a DHHS employee, but I've worked with several in multiple divisions. Not once have I seen an issue with personal hygiene. I have heard many make reference to how insulting it was to be told this by their Secretary though. I've also heard her become the butt of jokes. With all the problems she's facing, *this* is what she chose to emphasize?

That statement by Dr. Wos came during her address to DHHS employees when she first became Secretary. It was repeated in the infamous dress-code that was later retracted. It was insulting because it implies that all employees are slovenly.

There's also the story of the IT tech who showed up to work on Dr. Wos's computer wearing khakis and a button-up shirt. He was told not to come back so under-dressed.

Actually, republicans voted overwhelmingly to replace Woods with debra goldman. That is a sure sign of what is wrong with politics today. The majority of republicans voted against a great auditor just because she had a D by her name.

Dr. Wos won't fix anything. I'm not sure yet what her agenda is, but right out of the gate her record stinks.

Then she puts out a laughable and unreasonable dress policy (really, the folks who scrub toilets for DHHS are supposed to wear chinos to work?) and blames it on the HR Director. Then she hires Lightfoot, who seems to be in the running for Wacko of the Year. Then she goes up to the Capital and complains about all the empty positions and how DHHS is short-staffed, but she leaves out how she invoked a hiring freeze when she took the position of Secretary.

I get that there are huge problems at DMA. It would be hard to argue against that assessment. But DHHS is far more than just DMA. There are plenty of hard-working, honest employees within the various divisions that Dr. Wos is on her way toward completely demeaning and demoralizing.

She's not someone to cheer.

I suppose those that received this money will be put on temporary leave with pay. Then after a brief in-house review, they will get their same jobs back with an unblemished record. Heck, why not give them a pay increase too while they are at it. How often do these audits come around? Sounds to me like it should be yearly. The ones responsible for taking the "extra overtime" money should lose their jobs and have to pay back every dime. But once again, this will not happen as we have a very flawed system in more ways than one!

I have been a part of a behavioral healthcare organization for years. I have watched DHHS contract with "Consulting" groups to audit provider agencies in an attempt to recoup funds, or to take money back for legitimately provided services. I have seen some providers have to pay substantial amounts back to DHHS because the hired gun consulting firm subjectively declared the services provided didn't conform to the letter of the law or in this case, the service definition (this was before providers realized they could have some or all of this overturned in the appeals process). Bottom line, right or wrong, providers had to pay money back to DHHS. Will any of these DHHS employees have to pay money back to the state? Will any of the administrators who have received kickbacks and perks working on this ridiculous MMIS computer system for years have to answer to anyone/pay money back? If you're going to go after providers go after administrators too. I'm about to become a republican!

You are correct. This really goes back before Easley's time. Many have made millions. Angie is just the low hanging fruit. what I would like for Beth Woods to audit is the number of FSLA state employees across the state agencies who worked overtime and not get paid and follow th monet trial to determine who is really making the big money from this 12 year project.

Beth Wood did a lot of audits during Bev's term and Bev didn't do anything with the results, I certainly hope McCrory does and the GA follows up on that efficiency standard they floated last week.

It's time to nail it all down and clean house(s) of so many of these corrupt agency staffers.

This is possibly the only democrat in this country with an ounce of honesty and integrity. That's why I vote for her, and if she ran for governor with the same integrity, I'd vote for her there, too.

I am not self-employed, but if I were, I wouldn't be taking public money, and people could choose whether to do business with me. This agency is paid by us to serve us, and we have no options - ie., if you need Medicaid there's only one place you can apply. IMO, that's why we are entitled to be angry and to a full accounting along with firings.

And no money for the mentally ill, but plenty of overtime for well-paid ivory tower types. Not a good mindset for those in charge of health options for the poor.

We should give Mrs. Woods full reins to go after everyone, It's disgraceful the way those who we entrust our government to abuse their powers.

This fiasco goes back to even before Perdue's term. The incompetence of DHHS was well underway under Easley. They don't call him Easy E for nothin'! ACS, CSC, Cansler. Now Angie Sligh and a handful of others. Apparently it's too hot for any news agency in the Triangle to dig into because neither WRAL nor the N&O seem to be able to follow the money trail or read the HUGE difference between what the State asked for in the bidding process and what they actually bought. After this much time, I expect the loss to the taxpayers would be at least a billion. It's keeping a lot of people employed, for sure. CSC and HP both employ a large number of people. HP to run the current MMIS and CSC to recreate the old, antiquated MMIS with the "new" antiquated system. Heads at the State level SHOULD be rolling but they'll probably just get transferred to some other State agency. Maybe they can screw up highway bids and construction for DOT for awhile.

Oh by the way who do think been making millions from this. It has been the politicians.

dlcCpa-I find nothing "uninformed" about stating I was told I was expected to donate 20 hrs per week to the state. It is very nice of you to work salaried 80 hrs per week- is your salary twice what the private sector would make- or the same as a forty hour per week private sector employee and you are expected to donate the rest-

This is bigger than Angie. She has been targeted before without success. She has enough information to bring alot of of people down. Dr. Woz do not want to mess with that sister. I am telling you.
