Raleigh, N.C. — A dozen Department of Health and Human Services employees improperly collected $580,758 in overtime over the last five years while working to upgrade a Medicaid billing system, according to a state audit released Thursday.
Angie Sligh, the program director for the Medicaid Management Information System, or MMIS, collected 41 percent of the overtime paid out, according to the audit. Eight other managers collected another 47 percent of the overtime, while three rank-and-file employees collected the remaining 12 percent.
"That is a lot of money, and almost half of it went to one person," State Auditor Beth Wood said. "I would say it's fair to call this abusive, (an) abuse of the system."
DHHS obtained verbal approval from the Office of State Personnel to pay the overtime to "regular staff" who otherwise were prohibited from receiving pay for extra hours worked, according to the audit. The agency bolstered its argument for the overtime by noting that the federal government would pick up the bulk of the costs and that speeding the MMIS implementation would eventually save the state money.
The lack of documentation about the exception to state personnel rules meant no controls were in place to monitor the payments, according to the audit.
"Prohibiting overtime pay for exempt employees provides for better control and management of the state’s and agencies’ budgets. Consequently, it is imperative that any exceptions be thoroughly vetted and justified," the audit states.
DHHS even assigned someone to manually enter the overtime into the state's payroll system because the system could account for the overtime since there was no record of it being approved, according to the audit. There is no way to determine if the times and amounts were entered correctly or the cost of using state personnel to handle the task.
The MMIS implementation didn't meet its 2011 deadline – DHHS officials have said it will be online this July – so the employees continued to collect overtime until last month, when new agency officials learned of it and stopped the practice, according to the audit.
"Neither one of (the new personnel officials) knew what was going on. Then, you have DHHS over there doing it, so they're not going to run out and tell anybody," Wood said.
The Office of State Personnel adopted new policies and procedures last fall to ensure exceptions to overtime rules are properly documented.
Wood said the case could result in criminal charges if an investigation determines that the employees were paid for time they didn't actually work.
"This whole process was not managed appropriately," she said.
The audit was the second time in about two weeks that an audit has criticized spending in the Medicaid program. Previously, auditors determined that mismanagement and lax oversight led to high administrative costs in the program.
New DHHS Secretary Aldona Wos said in a statement Thursday that she considers the findings to be serious and has "already taken steps to ensure improved accountability within the department."
Department officials declined to say whether any action has been taken against Sligh or any of the other employees who were paid overtime, saying the audit was about policies and procedures, not individuals.

We, the taxpayers demand retribution for the people responsible for allowing this to ever have happened. They should pay the monies back, lose their jobs and forfeit any future pension and benefit privileges.

Beth Wood came in and ended the Mary Easely "over pay" audit, thinking it was political attack (and it was political buttering of the breat), pressed a republican underling to move on, and had expensive tastes in training, but has come through on others. Let's hope she does her job on all cases. She's hitting homers now with her Lori Morgan hairstyle. I like her when she is digging. She got the Alcohol enforcement on car use. Let's see how politically selective she is in her audits.

No one put anything in writing, so they'll all be able to say they "don't remember" approving this. What more proof do you need that they knew this was wrong? And justifying it by saying they're stealing our federal tax money as opposed to our state tax money? Fire all of them today, attach bank accounts, garnish wages, no benefits.

COMPENSATORY AND OVERTIME PAY/WORK There are two categories of state employees under the Fair Labor Standards Act (FLSA): those who are subject to the overtime compensation provisions of the federal FLSA and others who are exempt from these provisions. If you are an FLSA subject employee and work more than 40 hours in a week, you will either be given time off or be paid for the overtime. Both time off and pay are at a rate of one and a half hours for each hour worked over 40 in a week. The state normally gives time off. Your supervisormust authorize all overtime in advance.
The executive, administrative and professional employees who are exempt from these provisions are not paid overtime compensation but sometimes have more flexible work schedules.

Shouldn't be too difficult to garnish her paycheck. The state does it all the time. The payroll section under the state controllers office ( BEACON ) will be happy to acomodate Angie with a payback schedule.

Not to my knowledge. I'm not a DHHS employee, but I've worked with several in multiple divisions. Not once have I seen an issue with personal hygiene. I have heard many make reference to how insulting it was to be told this by their Secretary though. I've also heard her become the butt of jokes. With all the problems she's facing, *this* is what she chose to emphasize?
That statement by Dr. Wos came during her address to DHHS employees when she first became Secretary. It was repeated in the infamous dress-code that was later retracted. It was insulting because it implies that all employees are slovenly.
There's also the story of the IT tech who showed up to work on Dr. Wos's computer wearing khakis and a button-up shirt. He was told not to come back so under-dressed.

First, she tells all DHHS employees that they need to bathe and focus on personal cleanliness. Then she puts out a laughable and unreasonable dress policy (really, the folks who scrub toilets for DHHS are supposed to wear chinos to work?) and blames it on the HR Director. Then she hires Lightfoot, who seems to be in the running for Wacko of the Year. Then she goes up to the Capital and complains about all the empty positions and how DHHS is short-staffed, but she leaves out how she invoked a hiring freeze when she took the position of Secretary.
I get that there are huge problems at DMA. It would be hard to argue against that assessment. But DHHS is far more than just DMA. There are plenty of hard-working, honest employees within the various divisions that Dr. Wos is on her way toward completely demeaning and demoralizing.
She's not someone to cheer.

You are correct. This really goes back before Easley's time. Many have made millions. Angie is just the low hanging fruit. what I would like for Beth Woods to audit is the number of FSLA state employees across the state agencies who worked overtime and not get paid and follow th monet trial to determine who is really making the big money from this 12 year project.

He got his flat annual salary, no matter the hours worked and he put in a lot more than 8 hr average days - time critical deadlines every month and having to get others to give him the data sets to produce the reports etc. He never complained, his job was secure because he was the go to guy.

I am not self-employed, but if I were, I wouldn't be taking public money, and people could choose whether to do business with me. This agency is paid by us to serve us, and we have no options - ie., if you need Medicaid there's only one place you can apply. IMO, that's why we are entitled to be angry and to a full accounting along with firings.
And no money for the mentally ill, but plenty of overtime for well-paid ivory tower types. Not a good mindset for those in charge of health options for the poor.
