Raleigh, N.C. — Gumby's Pizza will not reopen on Hillsborough Street.
Health inspectors shut down the restaurant after giving it a score of 60.5.
Restaurants need a minimum score of 70 to stay open. Once a restaurant is shut down, it has to be brought back up to current building codes before it can re-open.
Gumby's owner Chance Hippler appealed the action in court. A judge dismissed that appeal Monday.
Hippler told WRAL Tuesday that he stopped fighting the Health Department because he found a new location. He said it should open in the next month or so.
