CD complaint leads singer to 5 on Your Side

"I always enjoyed music, and have been fascinated about having a CD ever since I've been able to sing," Ashe said.

In July, he and his wife Sharon contacted Joe Riley of Drummers Perspective Productions in Durham to start that process. The Ashes paid $1,500 to make Richard's dream come true.

However, when Sharon Ashe called to get the first round of work, the problems began. "I was given excuses why, you know, he didn't have it. It became on ongoing thing," Sharon Ashe said.

When nothing happened by August, the Ashes say Riley agreed to refund their $1,500.

“The last excuse that he gave us was that the gentleman that he works out of the studio with had taken the hard drive that had the music on it," she said.

The couple says even after six months, dozens of back-and-forth text messages and more than 15 phone calls, Riley never sent the money.

WRAL's 5 on Your Side called Riley, who said he couldn't produce the Ashe's CD because his partner was out of town.

He also said he's always intended to refund the money, but was waiting to go to court, something he said the Ashes had threatened.

He says he will pay them $500 a month over the next three months.

The Ashes said they will accept Riley's offer in the hopes of being able to try and make a CD again.

"I'll just know better next time," Richard Ashe said.
