Attorneys On CallAttorneys On Call
From overtime to unemployment, local labor attorneys answer your questions on workplace issues.
Stress from my job and boss were factors in me resigning. Waht are my rights about unemployment?
Question: I WAS HIRED FOR A JOB WHERE THEY KNEW I HAD A MEDICAL PROBLEM. STRESS
FROM JOB AND BOSS MADE MY PROBLEM WORSE. I RESIGNED WHAT ARE MY RIGHTS
ABOUT UNEMPLOYMENT

Answer: In most cases if you resign you lose your eligibility for unemployment benefits. However, if you resign for "good cause attributable to the employer," then you may still be able to get those benefits. The circumstances you describe certain seem as if you may have resigned for "good cause."

Ultimately, the question of whether you can get unemployment will be up to the NC Employment Security Commission. They have a lot of helpful information about eligibility on their website, which is at http://www.ncesc.com/individual/default.asp?init=true. You can also visit their offices to make a claim - dial 707-1290 locally in the Raleigh area or 888-737-0259 throughout the state for more information about where to go.

I hope this has helped and good luck to you.
