Can an employer have staggered shifts for employees?
Question: We work 12 hour shifts.We 2days on 3 days off,3 days on 2 days off.We only 2 weekends out of the mo.off,and only get a half hour for lunch,and 2 .15 min.breaks.The office worker get an hour and 2 .15 min.breaks for a 8 hour shft.Is this right for a company to do their workers like
this.and can the labor board do something about it.Thanks.
Answer: I'm afraid I'm struggling with the math. As far as the lunch and breaktimes go, employers are permitted to set the time limits for both, and those times can be different for different classes of employees (for example, an hour for those working very physical work and a half-hour for clerical workers). It's harder to answer your question about the staggered shifts - the general rule is that the employer can set the employee's schedule. If the employee is not exempt - meaning that the employee is eligible to be paid overtime wages - and the employee works more than 40 hours in the workweek, the extra hours beyond 40 are typically paid at "time and 1/2".
