Question: What is the law when you have not received your W-2 form yet from your previous employer? What are the steps to take in order to receive your W-2?

Answer: As a general rule, the employer has until the end of January to get W-2 forms to employees. There are no particular steps to obtain the form from the employer, other than to ask and perhaps advise them of the deadline. If that doesn't work, contact the IRS for assistance at 800-829-1040.

I would first suggest that you contact the employer. It could be a case of the W-2 being returned to the employer. I have personally recieved several back for the company that I work for because of people moving and leaving no forwarding address or because the address they gave on their employment forms is incorrect.
