It was an accident. I learned early on there is no such thing as an accident. There is always a cause, however remote. I am sure it was unintentional, but the use of the term "accident" implies it was unavoidable no matter what, and that is not correct.

What does it matter how old the driver is? It was an accident. If they were speeding they'd have been charged, if the cops thought they were at fault they'd have been charged. It's a terrible terrible accident

Thank yo MISEEM!! As tragic as this accident is I think when a child runs in front of a vehicle it is more the fault of the parent or gardian that should be watching the child than the driver of the vehicle.

Does it matter? The article says she ran out in front of the vehicle. Vehicle was going 35 mph, with no mention of this being over the speed limit. What are the charges? Not being able to see the future? I'm sorry that the child died, but to blame the driver based on what is in this article is groundless. Unless there is something else about the incident, you have no basis for saying this driver took the life of the child any more than you can say a train engineer took the life of someone parked on the tracks.

no charge for the driver! he is suffering enough for the rest of his life. How old is the driver? WRAL the other day, when another 4/5 year old was hit by a vehicle
where no charge was filed either. The driver was 70. So, is this another senior citizen, middle age or under 30 that took the life of this child?

I agree. Accidents happen. But you must always be aware of your surroundings 24/7. I do agree with you.

Odd headline. She was hit, and then killed, if you read it. Maybe "dies" would have been clearer. What a horrible thing to go through, for both her family and those who were looking after her when this happened. They won't get over it either.

You need to pay very close attention when you are behind the wheel 100% of the time

You must be someone that grew up in a large city and wasn't allowed to play outside. I'm sorry. This was an accident. She was FIVE. Negligent homicide? Get over yourself.
